New HCFA Rule Regarding Teleconsultations

A new HCFA Rule for Medicare Part B Payment for Teleconsultations in Rural Health Professional Shortage Areas published November 2, 1998 in the Federal Register. Payment will be made if the physician or other specified practitioner is furnishing a service for which payment may be made under Medicare to a beneficiary residing in a rural area that is designated as a health professional shortage area. This Rule also establishes a methodology for determining the amount of payments made for the consultation. The HCFA comments to the Rule indicate HCFA's effort to address many complex issues, including the location of the professional service, the licensure of the professionals providing the service, the payment for the service using a novel "conduit" approach in order to avoid any antifraud and abuse "kickback" concerns, and the like. Although the Rule is intended solely to provide limited telemedicine funding opportunities under Part B, the HCFA comments regarding the Rule provides implicit guidance regarding the views of HCFA regarding related issues (such as licensure and "kickback" concerns).
